SCSBA's staff attorney provides legal assistance responding by telephone to routine questions from board chairmen and superintendents as part of member services.

Although prohibited from providing legal counsel to individual parents, students, administrators, or school board members, the attorney may be able to answer broad questions about parliamentary procedure, school board pay, fiscal autonomy and governing local laws on a case-by-case basis. The attorney may advise the requestor to contact the S.C. Ethics Commission or the S.C. Office of Attorney General to obtain an informal or formal opinion.

All questions must be submitted in writing via mail, fax, or e-mail.

Districts involved in dismissal and/or expulsion hearings may request the staff attorney to act as counsel to the board when the district's attorney is presenting the administration's case.

In-service training on current policy and legal issues is available for boards and administrative staff.

Legal Defense Fund

The South Carolina School Boards Legal Defense Fund, established in 1979, provides partial assistance to districts for legal fees on issues with statewide impact. Trustees of the fund, financed by annual contributions from member districts, must approve requests.
